When a speeding offence has been committed with a company car, its manager must, in fact, report the offending driver to the competent authority within 45 days. Failure to do so may result in a criminal fine of up to €3,750, unless it is established that the vehicle has been stolen or any other case of force majeure. And be careful, the courts consider that the fact of being unable to designate the driver concerned does not exonerate the manager and/or the company from a possible criminal conviction.
We therefore advise you to keep a register of the users of your company’s vehicles in the future so that you will be able to comply with this obligation in the future.
