In this situation, it is important to distinguish between loan on future salary and advance payment of salary. Thus, if your employee asks you to pay him a remuneration for work that he has not yet done (for example, his February pay when it is January), this is a loan request that you are free to refuse.

But if it is a first request for an advance payment on salary for the month in question, you are obliged to accept it because it corresponds to the remuneration for work that has already been done. As such, it should be noted that the advance payment can only be paid from the 15th of the month and that it amounts to half of the employee’s monthly remuneration (i.e., the remuneration due to the employee for the first 15 days worked of the month).
