An employee whose child suffers from a grave illness, disability, or serious accident and who requires a sustained presence, and a restrictive care is granted leave for parental presence for a maximum of 310 working days (consecutive or not) over a period of 3 years.
Reminder: During the leave, the employee receives a daily parental presence allowance (Allocation Journalière de Présence Parentale :AJPP) paid by the family allowance fund. The employer therefore does not have to maintain his remuneration.
At the end of this 3-year period, the leave for parental presence may be renewed in the event of relapse or recurrence of the child’s pathology or when the severity of the pathology requires a sustained presence, and a restrictive care.
And, from now on, the leave for parental presence can also be renewed before the expiry of this 3-year period in respect of the same illness, accident, or disability of the child. A recent law allows, in fact, the employee to benefit, before the end of the 3-year period, from a new leave for parental presence of 310 days, to be taken over a new period of 3 years.
Consequence: Therefore, an employee may, over the same period of 6 years, have a leave for parental presence of up to 620 days.
To do this, the employee must present a new medical certificate drawn up by the doctor who follows the child. This document must state the essential nature of, regarding the treatment of the pathology or the need for support of the child, the continuation of the restrictive care and the sustained presence of the employee with his child. This certificate must also be the subject of an explicit consent of the Social Security Medical Control Service.
