In principle, if you have not declared your claim within 2 months of the judgment opening the bankruptcy proceedings, you will not be able to receive your share with the other creditors who declared their claims on time, unless you are able to obtain a foreclosure statement. This statement will be granted to you if you convince the court that your failure to declare your claim on time was not your fault. You may be excused if your client has failed to mention your name in the list of creditors that he has sent to the judicial representative. In this case, you don’t need to prove the existence of a causal link between this omission and the lateness of your declaration.
