A fixed-term contract can start with a trial period. However, to be valid, it must be expressly included in the employee’s employment contract.
In addition, it must respect the maximum durations provided for by the Labour Code. Thus, this trial period may not exceed a duration calculated at the rate of one day per week, within the limit of 2 weeks when the initial duration of the fixed-term contract is 6 months at most and within the limit of one month in other cases.
For a fixed-term contract of 4 months, the maximum duration of the trial period is therefore 2 weeks.
Please note: A usage or your collective agreement may provide for shorter trial periods.
